Establishing trust through clear boundaries and transparent agreements.
1. Service Transparency & Project Timeline
I operate on a "Live Build" model. Project progress is monitored via private GitHub repositories to ensure total transparency.
Project Abandonment: If the project remains inactive for more than 30 consecutive days due to client non-responsiveness (failure to provide required content, feedback, or approvals), the project will be archived. To resume an archived project, a reactivation fee may be charged, and the project will be rescheduled based on my current development queue.
2. Payment & Down Payment Policy
- Commencement: A 50% labor deposit is required to initiate the project and secure your slot in the development schedule. Once development has officially started, this deposit is non-refundable as it compensates for the specialized labor hours allocated.
- Final Settlement: The remaining 50% balance is due upon project sign-off and must be settled in full before the final handover of master credentials and live deployment.
3. Digital Asset Ownership & Domain Control
Full Ownership: Upon successful completion and final payment, 100% of the custom source code and assets are transferred to you. JDR WEB SOLUTIONS claims no ongoing rights to your intellectual property once the contract is fulfilled. Note: Third-party assets (such as premium fonts or stock media) remain subject to their respective licensing agreements.
Administrative Autonomy: I facilitate domain registration (e.g., .com, .ph) under your name and preferred accounts. Clients retain full administrative ownership of domains purchased with their own funds. Ongoing maintenance and renewal fees for domains and hosting are the sole responsibility of the client. JDR WEB SOLUTIONS is not responsible for service interruptions caused by expired domains or hosting accounts.
4. Data Privacy (RA 10173)
In accordance with the Philippine Data Privacy Act of 2012, I implement strict measures to ensure business credentials, customer data, and proprietary information remain confidential. All temporary development access granted to me is revoked or destroyed post-handover.
5. Liability & Force Majeure
JDR WEB SOLUTIONS shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the website post-handover. I am not responsible for security breaches or data loss resulting from client-managed credentials or third-party hosting failures.
Force Majeure: Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to: natural disasters, government actions, widespread internet/infrastructure outages, or hosting provider downtime.
6. Post-Launch Technical Support
I provide a 14-day technical support window post-launch to address any bugs or functional errors within the original scope of work.
Scope Boundaries: Technical support does not include new features, redesign requests, content updates, or additional development. Such requests will be treated as a new scope of work and quoted separately.
7. Portfolio & Attribution
Unless explicitly requested otherwise in writing, JDR WEB SOLUTIONS retains the right to feature the project URL, screenshots, and a description of the technical work in my official Portfolio and marketing materials to demonstrate development capabilities.
8. SEO & Search Engine Rankings
While JDR WEB SOLUTIONS implements modern SEO best practices (including Schema Markup, meta-optimization, and performance tuning), search engine rankings are not guaranteed. Rankings are determined by third-party search engines (Google, Bing) and are influenced by external factors such as competition, content quality, and algorithm updates.
